BACKGROUND:
Under current laws governing the reporting of child abuse and neglect, a court, when necessary to protect the child, may issue a preliminary injunction or temporary restraining order at the earliest point in an investigation. This temporary restraining order or preliminary injunction is currently used in situations of alleged abuse or neglect in children's homes.
SUMMARY:
The Department of Social and Health Services or a local law enforcement agency is required to investigate a report that a school employee committed an act of child abuse or neglect. The school district board of directors, a school official, or any interested party including parents may seek a temporary restraining order or preliminary injunction. The restraining order would prevent the school employee from having contact with children at school or as part of the person's employment.
The Department of Social and Health Services is specifically given the responsibility to investigate complaints of child abuse or neglect by school employees at schools.
