BACKGROUND:

 

Current law requires that each plat of real estate filed for record contain a statement of approval from the city, town or county engineer or by a licensed engineer acting on behalf of the city, town or county.  This statement of approval must address the layout of streets, alleys and other rights of way, design of bridges, sewage and water systems, and other structures.  There is no requirement that plats contain any statement regarding the availability of power, gas, and telecommunication services.

 

SUMMARY:

 

Every plat filed for record must contain a statement of approval from the city, town or county engineer or by a licensed engineer acting on behalf of the city, town or county as to the availability of power, gas, and telecommunication services.

 

 

EFFECT OF PROPOSED SUBSTITUTE:

 

Every plat filed for record shall be accompanied by an affidavit which shall describe the type and location of any utility service improvements installed, including sewage, water, power, natural gas, and telecommunications services and shall indicate if such utilities are connected to sources of such utility services.  The substance of the original bill is deleted.
