BACKGROUND:
Persons who make application for a public livestock market license are to provide a financial statement to the Department of Agriculture. It is unclear whether the department has authority to deny a license application if the applicant has insufficient assets to construct or operate the market.
The Department of Agriculture assigns sales days to public livestock markets. The department does not currently have explicit authority to revoke an allocation of sales days for nonuse.
Only the licensee or applicant can now challenge a decision to revoke, suspend or deny a license by the department.
SUMMARY:
The lack of sufficient net worth necessary to construct or operate a public livestock market is grounds for denial of an application.
The Department of Agriculture may revoke an allocation of sales dates awarded to a public livestock market if the sales dates are not used. The rate of usage to maintain an allocation of sales days is to be established by rule.
Persons other than just the licensee or license applicant may appeal a decision on the revocation, suspension, or denial of a public livestock market license.
