BACKGROUND:

 

Engineers and land surveyors are subject to statutory licensing requirements administered by a state board of registration for professional engineers and land surveyors.  While there are numerous exceptions to the registration requirements set forth in the current law, there is no express exception from these requirements for certified designers of on-site sewage disposal or public water systems.

 

The State Board of Health is authorized by statute to adopt rules and regulations relating to the disposal of wastes, including the design, construction and operation of waste collection, treatment, and disposal facilities.  However, there is no express authority for the State Board of Health to adopt rules and regulations governing the certification and licensing of persons authorized to design or install on-site sewage disposal or public water systems.

 

SUMMARY:

 

The statute requiring the registration of professional engineers and land surveyors shall not apply to the practice of any certified designer of on-site sewage disposal system or public water system.  The State Board of Health must adopt rules and regulations governing the certification and licensing of persons authorized to design or install on-site sewage disposal or public water systems.
