AN ACT Relating to irradiated foods; adding a new section to chapter 69.04 RCW; and creating a new section.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 69.04 RCW to read as follows:

          (1) All food sold in the state of Washington that has been irradiated shall be labeled with the following logo prominently displayed, accompanied by one of the following statements:

          (a) Treated with irradiation;

          (b) Treated by irradiation; or

          (c) Irradiated.

@lmLogo@ln!ae900@lo       (2) Food sold in bulk or in bulk containers shall be prominently labeled "Irradiated" and accompanied by the logo displayed in subsection (1) of this section.  If labeling of the container is not feasible or if labeling does not assure notice to the consumer, the merchant shall place in the vicinity of the bulk food a prominent sign with the product's name, the statement "Irradiated," and the logo displayed in subsection (1) of this section.  As an alternative, individual items may be conspicuously labeled.

          (3) If food is labeled in conformance with subsection (1) of this section  and sold in packages that contain more than one individually wrapped package, both the individually wrapped packages and the primary package  must be labeled in accordance with subsection (1) of this section.

          (4) Irradiated food ingredients shall be included in the list of ingredients and preceded by the statement "Irradiated".

          (5) Any advertising of an irradiated food shall identify the food as having been irradiated.

          (6) The director may use the authority provided in this chapter to enforce this section.

 

          NEW SECTION.  Sec. 2.     This act shall be known and cited as the Washington state irradiated food disclosure act.
