AN ACT Relating to county zoning; and amending RCW 36.70.050.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

        Sec. 1.  Section 36.70.050, chapter 4, Laws of 1963 and RCW 36.70.050 are each amended to read as follows:

          (1) Upon the creation of a planning agency as authorized in RCW 36.70.030 and 36.70.040, a county may engage in a planning program as defined by this chapter.  Two or more counties may jointly engage in a planning program as defined herein for their combined areas.

          (2) A county is granted the right and obligation to zone for use tidal and shoreline lands, as defined in RCW 79.90.030 through 79.90.050.  The county's area of control extends to a distance of one-half mile offshore.

          (3) A county may levy property taxes, as appropriate, over any facility located in the area of control discussed in subsection (2) of this section.  In the event of overlapping jurisdictional claims all revenues are to be shared equally by each jurisdiction.
