AN ACT Relating to auctioneers selling vehicles; amending RCW 46.70.025; adding a new section to chapter 18.11 RCW; and adding a new section to chapter 46.70 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 18.11 RCW to read as follows:

          An auctioneer licensed under this chapter need not comply with the requirements relating to an established place of business specified in RCW 46.70.023 (1), (2), (3), (4), (6), and (7) in order to sell vehicles at auction.

        Sec. 2.  Section 1, chapter 199, Laws of 1986 and RCW 46.70.025 are each amended to read as follows:

(1) An auctioneer licensed under chapter 18.11 RCW need not comply with the requirements relating to an established place of business specified in RCW 46.70.023 (1), (2), (3), (4), (6), and (7).

(2) The director may by rule waive any requirements pertaining to ((a)) any other vehicle dealer's established place of business if such waiver both serves the purposes of this chapter and is necessary due to unique circumstances such as a location divided by a public street or a highly specialized type of business.

NEW SECTION. Sec. 3.  A new section is added to chapter 46.70 RCW to read as follows:

          An auctioneer licensed under chapter 18.11 RCW may sell new or used mobile homes, travel trailers, motorcycles, or other vehicles at auction under a motor vehicle dealer's license issued under this chapter.
