AN ACT Relating to bids on public construction contracts; and adding a new section to chapter 39.04 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 39.04 RCW to read as follows:

          Notwithstanding the provisions of RCW 39.04.010, in the event all bids for a construction project exceed available funds as certified by the appropriate fiscal officer, and the low responsive bid does not exceed such funds by more than five percent, the contracting authority is authorized to negotiate an adjustment of the bid price, including changes in the bid requirements, with the low responsive bidder, in order to bring the bid within the amount of available funds.
