AN ACT Relating to landlords' liens against mobile homes; and adding a new section to chapter 59.12 RCW.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. A new section is added to chapter 59.12 RCW to read as follows:
(1) When a tenant in a mobile home park is evicted under this chapter, the landlord shall have a lien against the mobile home and its possessions for any past due rent owing, attorneys' fees, litigation costs, and any other reasonable expenses incurred to enforce the lien, to include any costs incurred in moving and selling the mobile home.
(2) The landlord's lien rights under this section shall be prior to those of all parties, secured or otherwise.
(3) Upon securing a writ of restitution, the landlord shall have the option of having the mobile home, along with its contents, removed from the mobile home park, or storing the mobile home in place until final disposition of the mobile home. The landlord shall be entitled to rent for storing of the mobile home at the same rate stated in the rental agreement for the mobile home. The landlord shall also be entitled to any costs incurred in maintaining the lot upon which the mobile home is located.
