AN ACT Relating to providing motorist services at service stations; and adding a new section to chapter 19.27 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 19.27 RCW to read as follows:

          (1) For the purposes of this section, a "service station" is defined as a retail business that makes more than fifty percent of its gross income from the sale of petroleum products for motor vehicles.

          (2) By July 1, 1990, each service station doing business in this state shall provide the following:

          (a) An air hose, water hose, and vehicle window washing equipment in an area easily accessible to the public; and

          (b) At least one toilet facility available for a patron's use equipped with handwashing facilities.

          (3) This section is self-executing, but cities and counties may further define these minimum standards and provide for their implementation by ordinance or resolution.

          (4) A service station in operation on the effective date of this act that can demonstrate that compliance with this section would result in extreme financial hardship is exempt from the specific requirement causing the hardship.  However, a service station that is substantially remodeled or rebuilt after the effective date of this act shall comply with the requirements of this section.
