HOUSE BILL NO. 1763
_______________________________________________
State of Washington 51st Legislature 1989 Regular Session
By Representatives Cooper, Zellinsky, Padden, Ferguson, Nutley, Todd and Anderson
Read first time 2/3/89 and referred to Committee on Transportation.
AN ACT Relating to motor vehicle common carriers; adding a new section to chapter 81.80 RCW; and creating a new section.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. The state legislature has prescribed what requirements are necessary for public liability insurance for motor vehicle common carriers to adequately protect both public and private property, both real and personal. Regulation at the state level is the most appropriate as individual common carriers conduct business within many cities and counties throughout the state.
It is therefore necessary and desirable for the state to preempt insurance regulations to prevent each city or county from applying its own separate regulation which could become an unreasonable financial and administrative burden upon the industry.
NEW SECTION. Sec. 2. A new section is added to chapter 81.80 RCW to read as follows:
The state of Washington hereby preempts all statutory and regulatory power over the area of public liability insurance for motor vehicle common carriers. Any motor vehicle that meets the public liability requirements prescribed under RCW 81.80.190 shall not be required to comply with any ordinances of a city or county prescribing insurance requirements.
