AN ACT Relating to barriers in roadways; adding a new section to chapter 9.91 RCW; and prescribing penalties.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 9.91 RCW to read as follows:

          (1) It is unlawful to place, maintain, or allow to remain across a roadway, a cable, chain, wire, or rope that is suspended less than eight feet above the roadway unless the barrier is marked with flags, banners, ribbons, or signs so as to be readily visible from a distance of five hundred feet in the daytime.

          (2) As used in this section, "roadway" includes every road, street, highway, driveway, path, or trail capable of carrying vehicular traffic, motorized or nonmotorized, whether on public or private property.

          (3) A person convicted of violating this section is guilty of a misdemeanor.
