AN ACT Relating to employment protection for classified school employees; adding a new section to chapter 28A.58 RCW; and declaring an emergency.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 28A.58 RCW to read as follows:

          (1) A school district or board of directors may purchase services by contract with individuals or business entities if those services were regularly purchased by valid contract at the districts prior to the effective date of this act.  However, no such contract may be executed or renewed if it would have the effect of terminating classified employees or classified employee positions, unless the positions are vacant through bona fide voluntary retirement, transfer, or resignation, existing at the time of the execution or renewal of the contract, except for employees in director/supervisor, professional, and technical positions.

          (2) For the purposes of this section:

          (a) "Director/supervisor position" means a position in which an employee directs staff members and manages a function, a program, or a support service.

          (b) "Professional position" means a position for which an employee is required to have a high degree of knowledge and skills acquired through a baccalaureate degree or its equivalent.

          (c) "Technical position" means a position for which an employee is required to have a combination of knowledge and skills that can be obtained through approximately two years of post-high school education, such as from a vocational-technical institution or community college, or by on-the-job training.

          (3) This section shall not apply to the purchase of services by contract with educational service districts under RCW 28A.21.086, pursuant to cooperative projects under RCW 28A.100.082 through 28A.100.092, or with other school districts, if the school district classified employees whose employment is affected by the contract are transferred to comparable positions with the educational service district or another school district.

 

          NEW SECTION.  Sec. 2.     If any provision of this act or its application to any person or circumstance is held invalid, the remainder of the act or the application of the provision to other persons or circumstances is not affected.

 

          NEW SECTION.  Sec. 3.     This act is necessary for the immediate preservation of the public peace, health, or safety, or support of the state government and its existing public institutions, and shall take effect immediately.
