AN ACT Relating to the revocation of juvenile driving privileges for failure to attend school; and adding new sections to chapter 46.20 RCW.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. A new section is added to chapter 46.20 RCW to read as follows:
(1) In addition to any other authority to revoke driving privileges under this chapter, the department shall revoke all driving privileges of a juvenile when the department receives notice from a school district that a student has dropped out of school. "Dropping out of school" means the failure to attend school for six weeks or longer with no evidence of having enrolled in another school district.
(2) The driving privileges of the juvenile revoked under subsection (1) of this section shall be revoked in the following manner:
(a) Upon receipt of the first notice, the department shall impose a revocation for six months, or until the juvenile presents evidence of a return to school for a period of three months;
(b) Upon receipt of a second notice, the department shall impose a revocation for one year or until the juvenile presents evidence of a return to school for a period of six months;
(c) Upon receipt of a third notice, the department shall impose a revocation until the juvenile reaches the age of eighteen.
(3) If the department receives notice from a school district that a student has completed the required period of school attendance for reinstatement of a license, the department shall immediately reinstate any driving privileges that have been revoked under this section.
(4) The department of licensing shall send notice of the revocation to the juvenile, the juvenile's parent or guardian, and the school district. The notice shall include the duration of the revocation and the terms for reinstatement.
(5) The hearing procedures established in this chapter shall apply to the revocation of juvenile driving privileges under this section.
NEW SECTION. Sec. 2. A new section is added to chapter 46.20 RCW to read as follows:
(1) A school district shall submit the names and addresses of all students who drop out of school to the department of licensing. "Dropping out" means the failure to attend school for six weeks or longer with no evidence of having enrolled in another school.
(2) Upon request of a juvenile whose license has been revoked under section 1 of this act, and completion of the required school attendance by the juvenile for reinstatement of the license under section 1 of this act, the school district shall submit an affidavit verifying enrollment and attendance at school for the required period of time to the department of licensing.
