AN ACT Relating to fiscal assistance for fire protection districts that have Indian trust lands within their boundaries; adding a new section to chapter 43.63A RCW; and making an appropriation.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION.  Sec. 1.  A new section is added to chapter 43.63A RCW to read as follows:

The department of community development shall establish an annual grant program to distribute moneys appropriated to the department for fire protection districts that have, located within their boundaries, Indian trust lands for which the tribe does not provide fire suppression services.  No fire protection district shall be eligible for a grant unless it has applied for a grant in the year in which the grant is to be made.  Each application must indicate the acreage of Indian trust lands that are located in the fire protection district.

Moneys shall be distributed by the department to each eligible fire protection district applying for a grant in any year based on the proportion that the acreage of Indian trust lands located in the district represents of the total Indian trust land acreage located in all the eligible fire protection districts applying for grants in that year.

NEW SECTION.  Sec. 2.     The sum of five hundred thousand dollars, or so much thereof as may be necessary, is appropriated for the biennium ending June 30, 1991, from the general fund to the department of community development for grants to fire protection districts that have Indian trust lands located in the district as provided in section 1 of this act.
