AN ACT Relating to the disposal of waste tires; amending RCW 70.95.510, 70.95.560, and 70.95.020; and adding a new section to chapter 70.95 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

        Sec. 1.  Section 5, chapter 345, Laws of 1985 and RCW 70.95.510 are each amended to read as follows:

          There is levied and there shall be collected by the department of revenue from every person engaging within this state in business making retail sales of new replacement vehicle tires, an annual assessment equal to the gross proceeds of the sales of new replacement vehicle tires sold within this state, multiplied by twelve hundredths of one percent.  All of the applicable provisions of chapter 82.32 RCW have full force and application with respect to taxes imposed under this section.  For the purposes of this section, "new replacement vehicle tires" means tires that are newly manufactured for vehicle purposes and does not include retreaded vehicle tires.

          This section expires January 1, 1990.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 70.95 RCW  to read as follows:

          (1) Beginning with purchases of vehicle registrations with December 1990 or later expiration dates, there is levied and there shall be collected by the department of licensing a one dollar per year tire disposal fee for every vehicle registered in the state of Washington under chapter 46.16 or 46.87 RCW.  For vehicles registered under chapter 46.87 RCW, the entire fee shall be included in the license fee without proration.

          (2) This section shall not apply to purchases of vehicle registrations with December 1995 or later expiration dates.  The appropriate standing committee or committees of the legislature shall review the need for continuing the fee under this section, based on the progress of state and local government programs to:  (a) Remove discarded vehicle tires from unauthorized dump sites; and (b) to accomplish other purposes of RCW 70.95.020(5).

 

        Sec. 3.  Section 5, chapter 250, Laws of 1988 and RCW 70.95.560 are each amended to read as follows:

          Any person who transports or stores waste tires without a license in violation of RCW 70.95.555 shall be guilty of a gross misdemeanor and upon conviction shall be punished under RCW ((9A.20.020(2))) 9A.20.021(2).

 

        Sec. 4.  Section 2, chapter 134, Laws of 1969 ex. sess. as last amended by section 2, chapter 345, Laws of 1985 and RCW 70.95.020 are each amended to read as follows:

          The purpose of this chapter is to establish a comprehensive state-wide program for solid waste handling, and solid waste recovery and/or recycling which will prevent land, air, and water pollution and conserve the natural, economic, and energy resources of this state.  To this end it is the purpose of this chapter:

          (1) To assign primary responsibility for adequate solid waste handling to local government, reserving to the state, however, those functions necessary to assure effective programs throughout the state;

          (2) To provide for adequate planning for solid waste handling by local government;

          (3) To provide for the adoption and enforcement of basic minimum performance standards for solid waste handling;

          (4) To provide technical and financial assistance to local governments in the planning, development, and conduct of solid waste handling programs;

          (5) To encourage storage, proper disposal, and recycling of discarded vehicle tires and to stimulate private vehicle tire recycling programs throughout the state.

          It is the intent of the legislature that local governments be encouraged to use the expertise of private industry and to contract with private industry to the fullest extent possible to carry out solid waste recovery and/or recycling programs.
