AN ACT Relating to health benefits for employees under school service contracts; and adding a new section to Title 28A RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to Title 28A RCW to read as follows:

          (1) Each contract for the purchase of services by a school district board of directors or an educational service district superintendent executed or renewed after the effective date of this act shall require the contractor to provide health care benefits to all employees who are performing services under the contract which were previously performed by noncertificated school employees.  The contract shall require the health care benefits to be substantially similar to the health care benefits provided by the school district or educational service district to noncertificated employees performing services similar to those services being performed under the contract.

          (2) This section does not apply to:

          (a) Temporary, nonongoing, or nonrecurring service contracts; or

          (b) Contracts for services previously performed by employees in director/supervisor, professional, and technical positions.

          (3) For the purposes of subsection (2) of this section:

          (a) "Director/supervisor position" means a position in which an employee directs staff members and manages a function, a program, or a support service.

          (b) "Professional position" means a position for which an employee is required to have a high degree of knowledge and skills acquired through a baccalaureate degree or its equivalent.

          (c) "Technical position" means a position for which an employee is required to have a combination of knowledge and skills that can be obtained through approximately two years of posthigh school education, such as from a vocational-technical institution or community college, or by on-the-job training.
