AN ACT Relating to uniform misdemeanor criminal code penalties; adding a new section to chapter 35.21 RCW; adding a new section to chapter 9.92 RCW; adding a new section to chapter 9A.04 RCW; and adding a new section to chapter 66.44 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 35.21 RCW to read as follows:

          Except as limited by the maximum penalty authorized by law, no city, town, or county may establish a penalty for an act that constitutes a crime as provided in Title 9, 9A, or 66 RCW that is less than the penalty prescribed for that crime in chapter 9.92 RCW, RCW 9A.04.030, or 66.44.180, respectively.

NEW SECTION. Sec. 2.  A new section is added to chapter 9.92 RCW to read as follows:

          Any city, town, or county that adopts this title or any section of this title directly or by reference shall be deemed to have adopted the penalty provisions of such crimes as provided in this chapter, without modification.  Penalty provisions adopted by a city, town, or county that are inconsistent with the penalty provisions of this chapter are void and are superseded by the penalty provisions provided in this chapter.

          Any city, town, or county that adopts this title or any section of this title directly or by reference shall be deemed to have adopted the penalty provisions of such crimes as provided in this chapter, without modification.  Penalty provisions adopted by a city, town, or county that are inconsistent with the penalty provisions of this chapter are void and are superseded by the penalty provisions provided in this chapter.

          Any city, town, or county that adopts this title or any section of this title directly or by reference shall be deemed to have adopted the penalty provisions of such crimes as provided in this chapter, without modification.  Penalty provisions adopted by a city, town, or county that are inconsistent with the penalty provisions of this chapter are void and are superseded by the penalty provisions provided in this chapter.
