AN ACT Relating to safer neighborhoods; adding new sections to chapter 43.63A RCW; and making an appropriation.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.     (1) A safe neighborhoods pilot program is established in Yakima county.  The program will be used to award a grant for at least one of the four purposes of:

          (a) Increasing the quality and quantity of arrests;

          (b) Increasing the rate and seriousness level of convictions;

          (c) Providing more severe penalties; and

          (d) Improving the quality of postpenalty programs.

          The grants must be used to supplement current spending levels and may not be used to supplant planned program spending.

          (2) The grant will be made available to unincorporated areas of Yakima county at twenty dollars per resident for an appropriation of one million nine hundred twenty thousand dollars.

          (3) The grant will be made available to incorporated areas of Yakima county at ten dollars per resident for an appropriation of nine hundred ten thousand dollars.

          (4) The grant will be made available to cities located in Yakima county at ten dollars per resident for an appropriation of nine hundred ten thousand dollars.

          (5) The director shall adopt rules for the implementation of this program.

          (6) The population count will be based on the office of financial management's 1988 population forecast.

 

          NEW SECTION.  Sec. 2.     (1) A safe neighborhoods program grant may be used for increasing the quality and quantity of arrests in unincorporated areas of the county and in the cities and incorporated areas of the county.

          (2) The grants may be used for training, equipment, temporary help, overtime pay, or any other method of improving the quality and quantity of arrests, except general salary increases.

 

          NEW SECTION.  Sec. 3.     (1) A safe neighborhoods program grant may be used for increasing the rate and seriousness level of convictions in unincorporated areas of the county and in the cities and incorporated areas of the county.

          (2) The grants may be used for training or equipment for the prosecutors or courts and for overtime pay.  The grants may not be used for general salary increases or for the costs of indigent defense programs.

 

          NEW SECTION.  Sec. 4.     (1) A safe neighborhoods program grant may be used for providing more severe penalties in unincorporated areas of the county and in the cities and incorporated areas of the county.

          (2) The grants may be used for training or equipment for corrections officers, temporary clerical or professional help, overtime pay, or new programs needed for the imposition of more severe penalties, but may not be used for general salary increases.  Grants may not be used for construction, except for minor remodeling to improve efficiency and safety.

 

          NEW SECTION.  Sec. 5.     (1) A safe neighborhoods program grant may be used for increasing the quality and quantity of postpenalty programs in unincorporated areas of the county and in the cities and incorporated areas of the county.

          (2) The grants may be used for training or equipment for program personnel, assistance to victims in obtaining restitution, notice systems to benefit victims, or overtime pay, but may not be used for general salary increases.

 

          NEW SECTION.  Sec. 6.     Sections 1 through 5 of this act are each added to chapter 43.63A RCW.

 

          NEW SECTION.  Sec. 7.     The sum of three million eight hundred thousand dollars, or as much thereof as may be necessary, is appropriated for the biennium ending June 30, 1991, from the general fund to the department of community development for the purposes of this act.
