AN ACT Relating to representation of truck drivers charged with nonmoving violations; and amending RCW 46.63.080.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
Sec. 1. Section 10, chapter 136, Laws of 1979 ex. sess. as amended by section 2, chapter 19, Laws of 1981 and RCW 46.63.080 are each amended to read as follows:
(1) Procedures for the conduct of all hearings provided for in this chapter may be established by rule of the supreme court.
(2) Any person subject to proceedings under this chapter may be represented by counsel. In the case of a nonmoving violation, the driver of a motor truck regulated under Title 81 RCW who is not the registered or legal owner of the vehicle may be represented by another person representing the trucking company.
(3) The attorney representing the state, county, city, or town may appear in any proceedings under this chapter but need not appear, notwithstanding any statute or rule of court to the contrary.
