AN ACT Relating to the fluoridation of water supplies; amending RCW 57.08.012; adding a new section to chapter 35.58 RCW; adding a new section to chapter 35.91 RCW; adding a new section to chapter 36.94 RCW; adding a new section to chapter 54.16 RCW; and adding a new section to chapter 87.03 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 35.58 RCW to read as follows:

          A metropolitan municipal corporation that was not adding fluoride to its metropolitan water supply before the effective  date of this section may not commence adding fluoride to its metropolitan water supply without first obtaining voter approval of a proposition calling for the fluoridation of the metropolitan water supply that was submitted to the voters of the metropolitan municipal corporation at a general election.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 35.91 RCW to read as follows:

          A city or town, including a code city, that was not adding fluoride to its municipal water supply before the effective date of this section may not commence adding fluoride to its municipal water supply without first obtaining voter approval of a proposition calling for the fluoridation of the municipal water supply that was submitted to the voters of the city or town at a general election.

 

          NEW SECTION.  Sec. 3.  A new section is added to chapter 36.94 RCW to read as follows:

          A county that was not adding fluoride to its system of water before the effective date of this section may not commence adding fluoride to its system of water without first obtaining voter approval of a proposition calling for the fluoridation of the system of water that was submitted to the voters of the county at a general election.

 

          NEW SECTION.  Sec. 4.  A new section is added to chapter 54.16 RCW to read as follows:

          A public utility district that was not adding fluoride to its potable water system before the effective date of this section may not commence adding fluoride to its potable water system without first obtaining voter approval of a proposition calling for the fluoridation of the potable water system that was submitted to the voters of the public utility district at a general election.

 

        Sec. 5.  Section 2, chapter 11, Laws of 1988 and RCW 57.08.012 are each amended to read as follows:

          A water district ((by a majority vote of its board of commissioners may fluoridate the water supply system of the water district.  The commissioners may cause the proposition of fluoridation of the water supply to be submitted to the electors of the water district at any general election or special election to be called for the purpose of voting on the proposition.  The proposition must be approved by a majority of the electors voting on the proposition to become effective)) that was not adding fluoride to its water supply system before the effective date of this section may not commence adding fluoride to its water supply system without first obtaining voter approval of a proposition calling for the fluoridation of the water supply system that was submitted to the voters of the water district at a general election.

 

          NEW SECTION.  Sec. 6.  A new section is added to chapter 87.03 RCW to read as follows:

          An irrigation district that was not adding fluoride to its water system used for domestic purposes before the effective date of this section may not commence adding fluoride to such a water system without first obtaining voter approval of a proposition calling for the fluoridation of the domestic water system that was submitted to the voters of the irrigation district at an irrigation district election.
