AN ACT Relating to industrial insurance payments made on behalf of an injured worker's child; amending RCW 74.20A.260; adding a new section to chapter 51.32 RCW; adding a new section to chapter 26.18 RCW; and adding a new section to chapter 26.09 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 51.32 RCW to read as follows:

          Any compensation paid under this chapter by the department or self-insurer, as the case may be, for or on account of an injured worker's child or children, which child or children are not in the custody of the injured worker, shall be treated for all purposes as if it were paid by that worker toward satisfaction of the worker's child support obligations.

 

        Sec. 2.  Section 24, chapter 183, Laws of 1973 1st ex. sess. as amended by section 34, chapter 435, Laws of 1987 and RCW 74.20A.260 are each amended to read as follows:

          (1) Disability payments made pursuant to Title 51 RCW shall be classified as earnings and shall be subject to collection action by the office for support enforcement under this chapter and all other applicable state statutes.

          (2) As provided in section 1 of this 1990 act, any compensation paid under chapter 51.32 RCW by the department of labor and industries or self-insurer, as the case may be, for or on account of an injured worker's child or children, which child or children are not in the custody of the injured worker, shall be treated for all purposes as if it were paid by that worker toward satisfaction of the worker's child support obligations.

 

          NEW SECTION.  Sec. 3.  A new section is added to chapter 26.18 RCW to read as follows:

          As provided in section 1 of this act, any compensation paid under chapter 51.32 RCW by the department of labor and industries or self-insurer, as the case may be, for or on account of an injured worker's child or children, which child or children are not in the custody of the injured worker, shall be treated for all purposes as if it were paid by that worker toward satisfaction of the worker's child support obligations.

 

          NEW SECTION.  Sec. 4.  A new section is added to chapter 26.09 RCW to read as follows:

          As provided in section 1 of this act, any compensation paid under chapter 51.32 RCW by the department of labor and industries or self-insurer, as the case may be, for or on account of an injured worker's child or children, which child or children are not in the custody of the injured worker, shall be treated for all purposes as if it were paid by that worker toward satisfaction of the worker's child support obligations.
