AN ACT Relating to the motor vehicle fund; amending RCW 46.68.130; creating a new section; and providing an effective date.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. The retaining of motor vehicle funds for transportation in the motor vehicle fund as opposed to transferring those funds to the general fund--state will ensure greater continuity and will ensure preservation of the funds for transportation needs.
Sec. 2. Section 46.68.130, chapter 12, Laws of 1961 as last amended by section 11, chapter 342, Laws of 1981 and RCW 46.68.130 are each amended to read as follows:
(1) The net tax amount distributed to the state in the manner provided by RCW 46.68.100, and all moneys accruing to the motor vehicle fund from any other source, less such sums as are properly appropriated and reappropriated for expenditure for costs of collection and administration thereof, shall be expended, subject to proper appropriation and reappropriation, solely for highway purposes of the state, including the purposes of RCW 47.30.030. For the purposes of this section, the term "highway purposes of the state" does not include those expenditures of the Washington state patrol heretofore appropriated or reappropriated from the motor vehicle fund.
(2)(a) The revenue distributed under RCW 46.68.100(5) shall be deposited as follows:
(i) Beginning July 1, 1990, thirty-three percent of the motor vehicle fund balance shall remain in the motor vehicle fund.
(ii) Beginning July 1, 1992, sixty-seven percent of the motor vehicle fund balance shall remain in the motor vehicle fund.
(iii) Beginning July 1, 1994, one hundred percent of the motor vehicle fund balance shall remain in the motor vehicle fund.
(b) If the transfer under (a) of this subsection would result in the general fund being reduced to below the previous biennium's level, as adjusted by the consumer price index, the transfer will be limited to the amount over the last biennium adjusted for the consumer price index.
NEW SECTION. Sec. 3. This act shall take effect July 1, 1990.
