AN ACT Relating to animals at large; and amending RCW 16.13.010 and 16.16.010.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

        Sec. 1.  Section 1, chapter 31, Laws of 1951 as last amended by section 15, chapter 415, Laws of 1985 and RCW 16.13.010 are each amended to read as follows:

          It shall be unlawful for the owner of any horses, mules, or donkeys((, or cattle of any age)) to permit such animals to run at large and not under the care of a herder in any ((territory which has been designated as a stock restricted area under chapter 16.24 RCW.  Such animals)) county in the state.  It shall be unlawful for the owner of cattle of any age to permit the same to run at large and not under the care of a herder in any territory which has been designated as a stock restricted area under chapter 16.24 RCW.  Cattle of any age may only run at large upon lands belonging to the state or to the United States when the owner thereof has in writing been granted grazing privileges.  Cattle of any age may run at large in a range area as provided in chapter 16.24 RCW without a herder except upon any land which has been enclosed by a lawful fence as set forth in chapter 16.60 RCW.

 

        Sec. 2.  Section 1, chapter 124, Laws of 1895 and RCW 16.16.010 are each amended to read as follows:

          It shall be unlawful for the owner of stallions in this state to permit the same to run at large.  Any person violating the provisions of this section shall be deemed guilty of a misdemeanor, and on conviction thereof shall be fined not less than one hundred and fifty dollars nor more than two hundred and fifty dollars, and one-half of the fine so enforced shall, in each case, be paid to the complaining witness:  PROVIDED, That this section will not apply to stallions running with and belonging to bands of horses which are ((herded and corralled by the owners once each day)) under the care of a herder.
