AN ACT Relating to drug awareness education; amending RCW 28A.120.030; adding new sections to chapter 28A.120 RCW; creating a new section; and declaring an emergency.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

Sec. 1. Section 205, chapter 518, Laws of 1987 and RCW 28A.120.030 are each amended to read as follows:

(1) The citizens of the state of Washington recognize the serious impact of alcohol and drug abuse on a student's self-concept and on the ability of students to learn. Therefore, the substance abuse awareness program is established: ((~~(1)~~)) (a) To aid students in the development of skills that will assist them in making informed decisions concerning the use of drugs and alcohol; ((~~(2)~~)) (b) to contribute to the development and support of a drug-free educational environment; and ((~~(3)~~)) (c) to help school districts in the development of comprehensive drug and alcohol policies leading to the implementation of drug and alcohol programs that contain prevention, intervention, and aftercare components.

(2) The legislature recognizes that the substance abuse awareness program established under subsection (1) of this section, and pursuant to the provisions of RCW 28A.120.032 through 28A.120.050, may not allow all districts an opportunity to receive grant funds to develop and implement a substance abuse awareness program. The legislature further recognizes a state obligation to commit state resources to the prevention of drug and alcohol abuse. Therefore, consistent with the goals stated under subsection (1) of this section, the substance abuse awareness program shall include a mobile substance abuse awareness program component.

NEW SECTION. Sec. 2. The superintendent of public instruction shall establish a mobile substance abuse awareness program to be staffed by personnel trained to present and discuss information about substance abuse with students. Upon request of school districts, the mobile substance abuse awareness program may be presented at school assemblies, at pep rallies, in classrooms, and at other school district or school building sponsored settings.

NEW SECTION. Sec. 3. (1) The mobile substance abuse awareness program personnel shall include in their presentations information about effective school district substance abuse programs and how further information about such programs might be obtained through the state clearinghouse for educational information within the office of the superintendent of public instruction. Through the clearinghouse or by other means, the superintendent shall notify identified high risk school districts of the mobile substance abuse awareness program.

(2) The mobile substance abuse awareness program shall be equipped with pamphlets, examples of existing substance abuse awareness and prevention curriculum or in-service programs, and other substance abuse information. The materials for the mobile substance abuse awareness program shall be determined in conjunction with the substance abuse advisory committee established under RCW 28A.120.038.

(3) The superintendent of public instruction and the substance abuse advisory committee are encouraged to invite persons identified as role models or strong advocates for the prevention of substance abuse to participate in the mobile substance abuse awareness program.

NEW SECTION. Sec. 4. (1) The superintendent of public instruction may accept, receive, and administer such gifts, grants, and contributions as may be expressly provided to support the mobile substance abuse awareness program established under RCW 28A.120.030(2) and section 2 of this act.

(2) There is hereby created in the custody of the state treasurer a revolving fund, to be known as the mobile substance abuse awareness program revolving fund. The superintendent of public instruction shall deposit in the fund all moneys received under this section. Money in the fund may be spent only for the purposes of supporting the mobile substance abuse awareness program. Disbursements from the fund shall be on authorization of the superintendent of public instruction or the superintendent's designee. The fund is subject to the allotment procedure provided under chapter 43.88 RCW, but no appropriation is required for disbursements.

NEW SECTION. Sec. 5. The mobile substance abuse awareness program established under RCW 28A.120.030 and sections 2 through 4 of this act shall be implemented at such time when funds are provided in the state operating appropriations act or when funds may be available from other public or private sources.

NEW SECTION. Sec. 6. Sections 2 through 4 of this act are each added to chapter 28A.120 RCW.

NEW SECTION. Sec. 7. This act is necessary for the immediate preservation of the public peace, health, or safety, or support of the state government and its existing public institutions, and shall take effect immediately.
