AN ACT Relating to on-site sewage systems; and adding a new section to chapter 43.20 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 43.20 RCW to read as follows:

          The state board of health, a local board of health as defined in RCW 70.05.010(3), or a combined city and county health department formed pursuant to chapter 70.08 RCW may not prohibit the issuance of a permit for installing a new on-site sewage system for a residential structure due to failure to meet minimum gross land area requirements when the property on which the residential structure stands is surrounded by properties served by on-site sewage systems approved prior to June 30, 1984.

          As used in this section, "on-site sewage system" refers to any system of piping, treatment devices, or other facilities that convey, store, treat, or dispose of sewage on the property where it originates or on adjacent or nearby property under the control of the user where the system is not connected to a public sewer system.
