AN ACT Relating to local improvement districts; adding a new section to chapter 43.20 RCW; and declaring an emergency.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. A new section is added to chapter 43.20 RCW to read as follows:
(1) The state board of health, a local board of health as defined in RCW 70.05.010(5), or a combined city and county health department formed pursuant to chapter 70.08 RCW may not require a property owner, as a condition to the granting of a permit specified in subsection (2) of this section, to agree, by covenant or otherwise, to:
(a) Join in any petition for the formation of a local improvement district or utility local improvement district; or
(b) Decline to protest the formation of a local improvement district or utility local improvement district.
(2) This section shall apply to a permit issued for the repair of an existing, failing on-site sewage system serving a single-family residence.
(3) As used in this section, "on-site sewage system" refers to any system of piping, treatment devices, or other facilities that convey, store, treat, or dispose of sewage on the property where it originates or on adjacent or nearby property under the control of the user where the system is not connected to a public sewer system.
NEW SECTION. Sec. 2. This act is necessary for the immediate preservation of the public peace, health, or safety, or support of the state government and its existing public institutions, and shall take effect immediately.
