AN ACT Relating to low-level radioactive waste surcharges; and amending RCW 43.200.170.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

        Sec. 1.  Section 3, chapter 2, Laws of 1986 and RCW 43.200.170 are each amended to read as follows:

          The governor may assess surcharges and penalty surcharges on the disposal of waste at the Hanford low-level radioactive waste disposal facility.  The surcharges may be imposed up to the maximum extent permitted by federal law.  Moneys received under this section shall be deposited in the general fund.  Fifty percent of the moneys retained by the state under this section shall be transmitted to the perpetual maintenance account established with the state treasurer to be used exclusively for surveillance and maintenance costs after the Hanford low-level radioactive waste facility closes, or to satisfy other post-closure surveillance and maintenance obligations the state may incur.
