AN ACT Relating to forfeiture of state-provided benefits by first-time offenders; adding a new section to chapter 69.50 RCW; adding a new section to chapter 74.04 RCW; adding a new section to chapter 50.20 RCW; adding a new section to chapter 51.32 RCW; adding a new section to chapter 28B.10 RCW; adding a new section to chapter 28B.12 RCW; and creating a new section.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. A new section is added to chapter 69.50 RCW under the subchapter heading "offenses and penalties" to read as follows:
A person who has violated for the first time the provisions pertaining to controlled substances in chapter 69.50 RCW, legend drugs in chapter 69.41 RCW,or imitation controlled substances in chapter 69.52 RCW, forfeits for ninety days following any conviction benefits conferred by the state with respect to public assistance under Title 74 RCW other than aid to children under chapter 74.12 or 74.20 RCW, unemployment compensation under Title 50 RCW, workers' compensation under Title 51 RCW, and student financial aid under Title 28A RCW.
NEW SECTION. Sec. 2. A new section is added to chapter 74.04 RCW to read as follows:
Eligibility for public assistance benefits under this title is subject to the conditions established in section 1 of this act. However, the portion of aid directed to dependent children under chapter 74.12 RCW and in support of dependent children under chapter 74.20 RCW shall not be forfeited under section 1 of this act.
NEW SECTION. Sec. 3. A new section is added to chapter 50.20 RCW to read as follows:
Eligibility for unemployment compensation benefits under this title is subject to the conditions established in section 1 of this act.
NEW SECTION. Sec. 4. A new section is added to chapter 51.32 RCW to read as follows:
Eligibility for workers' compensation benefits under this title is subject to the conditions established in section 1 of this act.
NEW SECTION. Sec. 5. A new section is added to chapter 28B.10 RCW to read as follows:
Eligibility for student financial aid under this chapter is subject to the conditions established in section 1 of this act.
NEW SECTION. Sec. 6. A new section is added to chapter 28B.12 RCW to read as follows:
Eligibility for the college work-study program under this chapter is subject to the conditions established in section 1 of this act.
NEW SECTION. Sec. 7. This act applies prospectively only and not retrospectively. It applies only to persons whose most recent applications for the benefits subject to this act that are currently being received by the person were made on or after the effective date of this act.
