AN ACT Relating to lien foreclosure; and adding a new section to chapter 60.04 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 60.04 RCW to read as follows:

          In any action to foreclose a lien on a single family residence or appurtenant garage, it shall be a complete defense that the full amount to be paid under the contract with the original contractor has been paid prior to the time the lien claim has been filed and served.  Amounts not paid to the original contractor at the time the owner is served with notice of the lien claim, whether or not due, shall reduce the defense provided in this section in like amount.
