AN ACT Relating to fish hatchery waste discharge permits; and adding a new section to chapter 90.48 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 90.48 RCW to read as follows:

          A permit shall not be required under this chapter for discharges from any upland fin fish hatchery for which a permit is not required under the federal water pollution control act, 33 U.S.C. Sec. 1251 et seq., or any regulations promulgated thereunder.  Permits issued under this chapter to such a hatchery shall not incorporate requirements more stringent than those required under such federal laws and regulations.
