AN ACT Relating to the sale of highway property; and adding a new section to chapter 47.20 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 47.20 RCW to read as follows:

          On the effective date of this act, the secretary of transportation shall offer for sale, in the manner set forth in RCW 47.12.063 or 47.12.283, so much of the state's interest in real property held for a right of way for a state highway in the vicinity south of 216th Street in King county as may be necessary to provide funding for completion of environmental impact statements relating to construction of a state highway extending state route number 509 from South 188th Street in King county to state route number 5.

          The environmental impact statement fund is created in the custody of the state treasurer.  All receipts from the sale held under this section shall be deposited into the fund.  Expenditures from the fund may be used only for completion of environmental impact statements relating to the extension of state route number 509 from South 188th Street to state route number 5.  Only the secretary of transportation or the secretary's designee may authorize expenditures from the fund.  Any funds remaining after completion of the state route 509 environmental impact statements shall be used by the department for construction or improvement of state highways.  The fund is subject to allotment procedures under chapter 43.88 RCW, but no appropriation is required for expenditures.
