AN ACT Relating to a mandatory retirement age for ferry captains; amending RCW 41.04.350; and adding a new section to chapter 47.64 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

        Sec. 1.  Section 1, chapter 159, Laws of 1979 ex. sess. and RCW 41.04.350 are each amended to read as follows:

          (1) Notwithstanding any other provisions of law, no employee of the state of Washington or any of its political subdivisions or any institution supported in total or in part by the state or any of its political subdivisions, other than employees covered by chapter((s)) 41.26 ((and)), 43.43, or 47.64 RCW, shall be compelled to retire solely on the basis of age prior to attaining seventy years of age.

          (2) All compulsory retirement provisions relating to public employees, other than employees covered by chapters 41.26 and 43.43 RCW, may be waived for individuals attaining seventy years of age by the individual's employer.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 47.64 RCW to read as follows:

          The captain of a Washington state ferry who has attained the age of sixty-five years shall be retired on the first day of the calendar month next succeeding that in which the captain attains the age of sixty-five.
