AN ACT Relating to advertising in department of wildlife publications; amending RCW 77.12.170 and 77.12.185; and creating a new section.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.     Each year the department of wildlife publishes pamphlets which explain the regulations affecting hunting and fishing.  Pamphlets often require dozens of pages and are costly to print.  Printing costs diminish the funds available to manage the state's fish and wildlife.  To defray the costs of printing, the legislature finds it to be in the public interest to allow the department of wildlife to charge advertisers for printing advertisements in the hunting and fishing regulation pamphlets and other department publications.

 

        Sec. 2.  Section 334, chapter 258, Laws of 1984 as amended by section 25, chapter 506, Laws of 1987 and RCW 77.12.170 are each amended to read as follows:

          (1) There is established in the state treasury the state wildlife fund which consists of moneys received from:

          (a) Rentals or concessions of the department;

          (b) The sale of real or personal property held for department purposes;

          (c) The sale of licenses, permits, tags, stamps, and punchcards required by this title;

          (d) Fees for informational materials published by the department;

          (e) Fees for personalized vehicle license plates as provided in chapter 46.16 RCW;

          (f) Articles or wildlife sold by the director under this title;

          (g) Compensation for wildlife losses or gifts or grants received under RCW 77.12.320; ((and))

          (h) Excise tax on anadromous game fish collected under chapter 82.27 RCW; and

          (i) Sale of advertising in department publications.

          (2) State and county officers receiving any moneys listed in subsection (1) of this section shall deposit them in the state treasury to be credited to the state wildlife fund.

 

        Sec. 3.  Section 2, chapter 56, Laws of 1979 as last amended by section 26, chapter 506, Laws of 1987 and RCW 77.12.185 are each amended to read as follows:

          (1) The director of wildlife may solicit advertising to be placed in informational materials published by the department and may collect a fee based on factors including the advertising rates charged by publications of similar quality and circulation.  The informational materials shall state that publication of an advertisement does not constitute an endorsement by the state of Washington.

          (2) The director may collect advertising fees and moneys to recover the reasonable costs of publication of informational materials by the department and shall deposit them in the state treasury to be credited to the state wildlife fund.
