AN ACT Relating to workplace safety; adding a new section to chapter 39.04 RCW; and declaring an emergency.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 39.04 RCW to read as follows:

          In determining who is the lowest and most responsible bidder on a contract, the state or a municipality may take into account the safety record of the bidder, or the firm or entity represented by the bidder, or anyone acting for such firm or entity.  The state or municipality must give notice to prospective bidders in the bid specifications that the safety record of the bidder may be considered in determining the lowest and most responsible bidder.

 

          NEW SECTION.  Sec. 2.     This act is necessary for the immediate preservation of the public peace, health, or safety, or support of the state government and its existing public institutions, and shall take effect immediately.
