AN ACT Relating to radiation machine inspection; and amending RCW 70.98.090.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

        Sec. 1.  Section 9, chapter 207, Laws of 1961 as amended by section 2, chapter 372, Laws of 1985 and RCW 70.98.090 are each amended to read as follows:

(1) The agency or its duly authorized representative shall have the power to enter at all reasonable times upon any private or public property for the purpose of determining whether or not there is compliance with or violation of the provisions of this chapter and rules and regulations issued thereunder.

(2) Facilities that operate radiation machines shall be regularly inspected by the agency.  Hospitals, medical, dental, chiropractic, podiatric, and other health care facilities using radiation machines shall be inspected at least annually.  Industrial, research, veterinary, and other facilities using radiation machines shall be inspected at least every three years.

(3) The department shall establish an inspection fee schedule that is sufficient to fund completely the cost of inspections.
