AN ACT Relating to public lands; and amending RCW 79.01.384.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
Sec. 1. Section 96, chapter 255, Laws of 1927 as last amended by section 172, chapter 21, Laws of 1982 1st ex. sess. and RCW 79.01.384 are each amended to read as follows:
(1) A right of way through, over, and across any state lands or state forest lands, may be granted to any municipal or private corporation, company, association, individual, or the United States of America, constructing or proposing to construct, or which has heretofore constructed, any telephone line, ditch, flume, or pipe line for the domestic water supply of any municipal corporation or transmission line for the purpose of generating or transmitting electricity for light, heat, or power.
(2) The land for which a right of way has been granted under subsection (1) of this section may be opened to access by the general public for hiking or horseback riding by the department when the use is not inconsistent with the use of the grant holder or leasee. The department may adopt rules governing the use of the rights of way including rules closing access by the general public to areas set aside as a watershed to provide potable water to a governmental unit.
