AN ACT Relating to notice given to the Washington utilities and transportation commission and other private and public agencies; and adding a new section to chapter 70.95 RCW.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. A new section is added to chapter 70.95 RCW to read as follows:
The local government entity responsible for establishment of disposal fees or charges, or the owner and/or operator of a solid waste disposal facility that is identified and included in the local comprehensive solid waste management plan shall provide written notice of increases or decreases in disposal fees and charges to the Washington utilities and transportation commission, to solid waste collection companies operating pursuant to chapter 81.77 RCW in the area covered by the plan, and to any city or town that operates solid waste collection services within the area covered by the plan. Any increase or decrease in disposal fees or charges shall take effect ninety days after the date on which notice has been sent to the commission, private solid waste collection companies, or public solid waste collection agencies. The effective date shall be used for the purposes of permitting solid waste collection companies time to review the impact of the increase or decrease on customer rates, to prepare and file the rate filing with the commission, for public comment and commission review, and for the purposes of approving the pass-through of such fees and charges to collection rates as required by RCW 81.77.160 where the solid waste collection company is regulated by the commission. Nothing in this section shall prohibit any increase or decrease in disposal fees or charges from taking effect sooner where the parties have so agreed, provided approval of the collection rates by the commission has been obtained if necessary.
