AN ACT Relating to notice given to the Washington utilities and transportation commission and other private and public agencies; and adding a new section to chapter 70.95 RCW.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. A new section is added to chapter 70.95 RCW to read as follows:
(1) The local government entity responsible for establishment of disposal fees or charges, or the owner and/or operator of a solid waste disposal facility that is identified and included in the local comprehensive solid waste management plan shall provide notice of increases or decreases in disposal fees and charges to the Washington utilities and transportation commission, to solid waste collection companies who operate pursuant to chapter 81.77 RCW within the area covered by the plan, and to any city or town that operates solid waste collection services pursuant to chapter 35.21 or 35A.21 RCW within the area covered by the plan.
(2) Any increase or decrease in disposal fees or charges shall take effect one hundred eighty days after the date on which the notice required in subsection (1) of this section has been sent, except when the owner and/or operator and solid waste collection companies agree that the increase or decrease may take effect sooner, and, where required by law, the Washington utilities and transportation commission approves, on a permanent basis, collection company rates affected by such increase or decrease.
