AN ACT Relating to limitation of actions; and adding a new section to chapter 4.16 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 4.16 RCW to read as follows:

          Any action seeking the invalidation of a law on statutory or constitutional grounds and damages or refunds based upon enforcement of the law, shall not be barred by a statute of limitations, however, once a law is declared invalid, the applicable statute of limitation shall begin to run from the date of the highest court decision which rendered the law invalid.
