AN ACT Relating to the transfer of state forest lands to the counties; and adding a new section to chapter 76.12 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 76.12 RCW to read as follows:

          (1) A county legislative authority may acquire forest land located in the county that was taken by the state under RCW 76.12.030.

          (2) The department shall return the land, if the county:

          (a) Legislative authority makes the request upon approval by a majority vote;

          (b) Has a ten-year management plan approved by the forest practices board which complies with all state laws relating to forest practices;

          (c) Agrees to manage the land on a sustained yield basis;

          (d) Agrees to update the ten-year management plan every five years and to submit the updated plan for approval by the forest practices board; and

          (e) Agrees to repay money owed to the resource management cost account or any other fund or account under the authority of the department or the treasurer for the benefit of the department.  The department and county legislative authority must agree to a repayment schedule that is tied to the sale of timber on the land acquired by the county.
