Forwarded herewith is documentation of the computations utilized in developing the debt limitation for Fiscal Year 1998.
In accordance with constitutional and statutory requirements, I hereby certify, for the fiscal year ending June 30, 1998, that the maximum debt authorization subject to limitation is $4,647,805,000 and, further that the State is empowered to contract additional bond indebtedness subject to limitation of $417,246,000.
A copy of this notification has been forwarded to each elected official of the State and each member of the Washington Legislature.

President Owen welcomed and introduced Dr. Carlos Torres y Torres Lara, the President of the Congress of the Republic of Peru and his wife Miguel Angel Velasquez. Dr. Torres Lara has been designated by the government of Peru to be the Honorary Consul of Peru in Washington State.
With permission of the Senate, business was suspended to permit Dr. Torres Lara to address the Senate.

RULING BY THE PRESIDENT
President Owen: “In ruling upon the point of order raised by Senator Fraser, the President finds that Senate Bill No. 6123 is a measure which makes several changes to statutes concerning animal health and the suppression of animal diseases by the Department of Agriculture. For these purposes, the measure defines “animal” to exclude “fish.”
“The Committee on Agriculture and Environment amendment on page 2, after line 2, explains that “farm raised fish” are part of animal agriculture. However the prevention of diseases related to farm raised fish is under the jurisdiction of the Department of Fish and Wildlife.
“The President, therefore, finds that the proposed committee amendment does not change the scope and object of the bill and the point of order is not well taken.”
The Committee on Agriculture and Environment amendment on page 2, after line 2, to Senate Bill No. 6123 was ruled in order.

POINT OF INQUIRY
Senator Fraser: “Senator Swecker, would you please explain clearly why this amendment is needed?”
Senator Swecker: “Thank you, Senator Fraser. In 1985, the Washington State Legislature passed a law declaring that aquaculture--that is the farming of aquatic products--was a part of agriculture in this state. Nevertheless, there were concerns that some the impacts of aquaculture could affect our natural resources and therefore there was an appropriate role for both the Department of Agriculture and the Department of Fish and Wildlife, with regard to the regulation of disease.
“That has been the policy of the state right up until the present and this bill preserves that joint relationship--that is the Department of Fish and Wildlife and the Department of Agriculture have joint rule-making authority with regard to disease in this state. The fact of the matter is, because aquaculture has participated in state disease policies with regard to fish, both the private and the public sector have been a beneficiary of those efforts. In fact, the disease policy of the state has been very successful; it applies to both public and private fish. In the future, I think, it will continue to work in a very cooperative and beneficial manner for both parties.
“Right now, if somebody in the state wants to do something with a farmed aquatic product, they have to get permission from the Department of the Fish and Wildlife to move those products around. At the same time, we have the benefit of the fact that we are a part of agriculture, eligible for funding from the federal government--for certain kinds of things. So, we think it is important for our industry that we preserve that relationship if we can.”
POINT OF INQUIRY
Senator Spanel: “Senator Swecker, in your explanation you began by stating about what occurred in 1985. I know that did happen then, but I didn't really understand why this particular amendment needs to be in this bill, because the 1985 statute still holds.”
Senator Swecker: “When the Department of Agriculture drafted these particular revisions to their animal/health statutes, I think an error specifically excluded fish from the definition of animal. It came in with a piece of language that said, 'Animals shall include everything except humans, insects and fish.' Up until this time, for disease purposes in this state, fish had been included as animals and this changes that. I think it would be a mistake for many, many reasons to do that.
