(1) The owner or operator of a Class 1 facility must submit a prevention plan to ecology at least 120 calendar days prior to their planned date for beginning operations in Washington state.
(2) One electronic copy of the plan and appendices must be submitted to ecology. Ecology will maintain electronic submittal instructions on the spill prevention, preparedness, and response program website.
(3) A plan may be combined with a contingency plan required by chapter
173-182 WAC. If combined with a contingency plan, the prevention plan must meet the requirements of this chapter and be clearly separated from contingency plan elements.
(4) The plan submitter may request that proprietary information be kept confidential under RCW
43.21A.160.
