(1) If married, you must provide your spouse's written consent to the option you selected under WAC
415-108-326. If, as a married member, you do not provide spousal consent, the department will pay you as a retiree, a joint and one-half survivor benefit allowance and record your spouse as the survivor in compliance with RCW
41.40.188 (2)(a),
41.40.660 (2)(a), and
41.40.845 (2)(a).
(2) Spousal consent is not needed to enforce a marital dissolution order requiring the department to pay an ex-spouse under RCW
41.50.790.
(3) "Spousal consent" means that your spouse consents to the retirement option you selected. Your spouse's notarized signature on a completed retirement application constitutes spousal consent.
