(1) A proposed decision shall be prepared when:
(a) An appeal has been heard by only one member of the board;
(b) An appeal has been heard by only two members of the board and the two members cannot agree on a conclusion;
(c) An appeal has been heard by a hearing officer; or
(d) The board shall otherwise elect to do so.
(2) If an exception as provided in WAC
456-10-730 is not submitted to the board within twenty calendar days of the date of mailing of the proposed decision, the proposed decision shall be deemed the final decision of the board unless the decision specifies otherwise.
