(1) A petition for reconsideration is not available where a proposed decision was first issued.
(2) Where a final decision has been issued and no proposed decision was first issued, any party may submit a petition for reconsideration with the board together with proof of service pursuant to WAC
456-10-410 within ten business days from the mailing of the final decision. The board may require or any party may at its own option, within ten business days of the date of the letter acknowledging receipt by the board of the petition for reconsideration, submit to the board a response together with proof of service pursuant to WAC
456-10-410.
(3) The submitting of a petition for reconsideration shall suspend the final decision until action by the board. The board may deny the petition, modify its decision, or reopen the hearing.
