Date of Adoption: July 26, 2000.

Purpose: Amend personal use rules.

Citation of Existing Rules Affected by this Order: Amending WAC 232-12-187.

Statutory Authority for Adoption: Section 7, chapter 107, Laws of 2000.

Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.

Reasons for this Finding: There is an extreme risk of fire in Eastern Washington, and the department of [is] coordinating fire protection with the Department of Natural Resources. This rule is for the protection of department lands and surrounding areas. There is insufficient time to adopt permanent rules.

Use of department lands -- Open fires prohibited.

Notwithstanding the provisions of WAC 232-12-187, effective immediately until further notice it is unlawful to set or maintain any open fire on department owned or controlled lands in Eastern Washington, except that self-contained camp stoves are permitted and fires may be set and maintained within metal- or concrete-lined fire pits located within designated campgrounds. Fires in hand-dug pits are prohibited.
