Subject of Possible Rule Making: Chapter 246-260 WAC, Water recreation facilities.

Statutes Authorizing the Agency to Adopt Rules on this Subject: Chapter 70.90 RCW, Water recreation facilities.

Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: Revision to the rule is being considered to address changes in the program that have occurred since the last revision of the chapter. The revision is intended to address the programmatic changes, establish performance standards, define roles between local health jurisdictions and the Department of Health, consolidate and streamline the rule language, and establish a model program for bathing beaches.

Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: None.

Process for Developing New Rule: Collaborative rule making. The State Board of Health and the department will work with interested parties to revise the rules.

Interested parties can participate in the decision to adopt the new rule and formulation of the proposed rule before publication. The State Board of Health and the department will work with a steering committee and workgroups to discuss the implications of developing new rules and to develop rule language.
