PREPROPOSAL STATEMENT OF INQUIRY

     Subject of Possible Rule Making: Certifying crisis stabilization units (new), chapter 388-865 WAC.

     Statutes Authorizing the Agency to Adopt Rules on this Subject: Chapter 375, Laws of 2007 (SSB 5533); RCW 71.05.020 and 71.24.035.

     Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: The 2007 legislature passed a provision (SSB 5533) requiring the department to certify crisis stabilization units that meet minimum standards.

     Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: Department of health is required under SSB 5533 to license the crisis stabilization units. The mental health division will coordinate the development of this rule with DOH.

     Process for Developing New Rule: The department invites the interested public to review and provide input on the draft language of this rule. Draft material and information about how to participate may be obtained from the department representative listed below. At a later date, DSHS will file a proposal with the office of the code reviser with a notice of proposed rule making. A copy of the proposal will be sent to everyone on the mailing list and to anyone who requests a copy.
