     Effective Date of Rule: Immediately.

     Purpose: Amend personal use fishing rules.

     Citation of Existing Rules Affected by this Order: Amending WAC 232-28-619.

     Statutory Authority for Adoption: RCW 77.12.047 and 77.04.020.

     Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.

     Reasons for this Finding: The July 1 opening date allowing retention of adult chinook and coho was inadvertently included in the permanent regulation intended to begin September 1. During July and August adult spring chinook are present in the system and require protection in order to meet conservation objectives. There is insufficient time to adopt permanent rules.

NEW SECTION
WAC 232-28-61900K   Exceptions to statewide rules -- Quinault River.   Notwithstanding the provisions of WAC 232-28-619, it is unlawful to violate the following provisions in waters of the Quinault River from the mouth at the upper end of Quinault Lake upstream to the National Park boundary, provided that unless otherwise amended, all permanent rules remain in effect:

     (1) Effective immediately through August 31, 2009, daily limit six jack salmon, minimum size 12 inches in length.

     (2) Effective September 1, 2009 until further notice, daily limit six salmon, only two of which may be adults; minimum size 12 inches in length. Release chum and sockeye.
